Workbelt Terms and Conditions

These Terms and Conditions govern the use of the platform and services provided by HI.ERD LTD. trading as Workbelt, OnDemand Pro, and Workfolio for Trades ("Workbelt", "we", "us", or "our"). The platform is available for use by tradespeople (individuals or businesses) and their customers (individuals or businesses) ("you" or "users").
By accessing or using the platform, you agree to these Terms and Conditions. If you do not agree to these terms, please do not use our services.
1. Definitions
- "Company," "we," "us," or "our" refers to HI.ERD LTD., trading as Workbelt, OnDemand Pro, and Workfolio for Trades.
- "Tradesperson" or "Tradespeople" refers to any individual, business, or company that registers on the platform to provide trade services, issue quotes, and invoices to customers.
- "Customer" refers to any individual, business, or company that interacts with a tradesperson through the platform, including accepting quotes, receiving invoices, and making payments.
- "Platform" refers to our website, mobile applications, and associated services that allow tradespeople and customers to communicate, exchange quotes, manage jobs, and process payments.
- "On Demand Pro" refers to the service within the platform that allows tradespeople to receive job opportunities sourced by the platform.
- "Stripe" refers to the third-party payment processor used to manage financial transactions on our platform.
2. Eligibility
- Tradespeople: To use Workbelt, you must be a registered business or self-employed individual in the UK, and over the age of 18. You are responsible for providing accurate business and payment information and ensuring compliance with any applicable laws and regulations in your industry.
- Customers: To use the platform to request quotes, pay invoices, or engage tradespeople, you must be over the age of 18 and agree to these Terms and Conditions.
3. Quotes
3.1 For Tradespeople (Individuals and Businesses)
- When issuing a quote through the platform, you are solely responsible for ensuring that the services listed, pricing, and timelines are accurate and clearly communicated.
- By issuing a quote, you acknowledge that the acceptance of your quote by a customer constitutes an agreement to provide the specified services at the quoted price.
- Payments: While we provide tools to manage and track quotes, all payments are facilitated through Stripe. You must comply with Stripe’s terms and conditions, which can be found here.
- Stripe Fees: You may incur fees for processing payouts via Stripe. These fees are governed by Stripe’s terms and conditions, and you are responsible for reviewing and understanding these fees before issuing quotes or invoices.
- You are solely responsible for the services you provide, including delivery, quality, and timeliness of the work. We do not guarantee payment unless processed through the Stripe payment system.
3.2 For Customers (Individuals and Businesses)
- By accepting a quote through the platform, you agree to engage the tradesperson for the specified services at the quoted price.
- Payment Information: Your payment card details are securely collected to confirm acceptance of the quote. However, you will not be charged until the work is completed and an invoice is issued, unless alternative payment terms are agreed directly with the tradesperson.
- Fees: Customers may incur administrative or service fees on quotes or services provided via the platform, including On Demand Pro services. Any such fees will be clearly displayed at the time the quote is generated or before services are agreed.
- If you choose to pay via other methods (e.g., cash, bank transfer, cheque), this arrangement must be made directly with the tradesperson and is outside the platform’s responsibility.
- You are responsible for ensuring that the scope of work, pricing, and timelines are clearly understood before accepting the quote.
4. Invoices and Payments
4.1 For Tradespeople (Individuals and Businesses)
- Upon completion of a job, you can issue an invoice through the platform. It is your responsibility to ensure the invoice accurately reflects the services provided and the agreed-upon terms.
- Once the customer acknowledges the invoice, they are responsible for making payment. Payments can be processed through Stripe or other methods agreed upon with the customer.
- Responsibility for Disputes: You are responsible for handling any disputes or refund requests from customers directly. Workbelt is not involved in the resolution of disputes and will not mediate between the parties.
- Stripe Fees: You may incur fees when receiving payouts via Stripe. These fees are determined by Stripe, and you are responsible for reviewing and understanding them.
4.2 For Customers (Individuals and Businesses)
- By acknowledging an invoice through the platform, you confirm that the work has been completed to your satisfaction and that you agree to proceed with payment.
- Payment Process: Payments made via the platform are processed through Stripe. If alternative payment methods (e.g., cash, bank transfer, cheque) are used, you must arrange this directly with the tradesperson. Workbelt is not responsible for managing or processing payments made outside of Stripe.
- Fees: You may incur administrative or service fees when making payments via the platform, including On Demand Pro services. These fees will be clearly shown at the time of invoicing and before payment is processed.
- Any disputes regarding the quality of work or refunds must be resolved directly with the tradesperson. Workbelt is not liable for disputes between you and the tradesperson.
5. On Demand Pro Jobs (Job Sourcing Service)
5.1 For Tradespeople (Individuals and Businesses)
- The On Demand Pro service allows you to receive job leads sourced through our platform.
- Job Acceptance: If you accept a job through On Demand Pro, you agree to provide the services as described in the job listing. It is your responsibility to communicate directly with the customer to finalize details and arrange work.
- Fees: By accepting jobs through On Demand Pro, you may be subject to additional fees or commissions. These will be clearly communicated to you before accepting any job.
- You are solely responsible for fulfilling the job and ensuring customer satisfaction. Workbelt does not guarantee the outcome of any job sourced through On Demand Pro.
5.2 For Customers (Individuals and Businesses)
- When you request a tradesperson through the On Demand Pro service, we will connect you with tradespeople available in your area. However, we do not guarantee the availability or quality of any tradesperson.
- Direct Engagement: Any agreement for services provided via On Demand Pro is strictly between you and the tradesperson. We do not act as an intermediary or guarantee any aspect of the service, including quality or timeliness.
- Fees: Customers may incur administrative or service fees when using the On Demand Pro service. These fees will be clearly displayed at the time of job request or acceptance and before services are agreed.
- Payment: Payments for On Demand Pro jobs can be made through the platform using Stripe or through alternative arrangements directly with the tradesperson. Workbelt is not responsible for payments made outside of the Stripe system.
6. Fees and Charges
- Tradespeople (Individuals and Businesses): The platform may charge fees for premium features, on the pro plan. These fees will be in the form of a subscription which you can sign up for. Additionally, you may incur fees when receiving payouts via Stripe, and you should refer to Stripe’s terms for more information on these fees.
- Customers (Individuals and Businesses): You may incur administrative or service fees when paying invoices. These fees will be clearly displayed at the time of service or payment, and you agree to pay any applicable fees.
7. Limitation of Liability
- Tradespeople: Workbelt acts solely as a platform to facilitate quotes, invoicing, and job sourcing. We do not guarantee the availability of work, payment from customers, or the success of jobs sourced through On Demand Pro. You are fully responsible for fulfilling your contractual obligations to customers.
- Customers: We do not guarantee the quality or availability of tradespeople using the platform. You agree that any issues regarding the quality of services, payments, or refunds are solely between you and the tradesperson.
- Workbelt is not liable for any indirect, incidental, or consequential damages arising from the use of the platform, including but not limited to lost revenue, profits, or business opportunities.
8. Data Protection and Privacy
Your use of the platform is subject to our Privacy Policy, which outlines how we collect, use, and store your personal data. By using the platform, you agree to the collection and processing of your data in accordance with our Privacy Policy.
9. Termination
We reserve the right to terminate or suspend access to the platform for any user who violates these Terms and Conditions, engages in fraudulent activities, or is found to be misusing the platform.
10. Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
11. Changes to These Terms
We may update these Terms and Conditions from time to time to reflect changes in our services, legal obligations, or business practices. You will be notified of any significant changes via email or platform notifications. Continued use of the platform after any changes constitutes acceptance of the updated Terms.
